When you think you have heard it all, this is the everlasting last word. Loser sues loser.
We have been following the marathon story of the widow Darlene Zachry, et al as the facade of conspired evidence in the case of the forged will of her late husband, crumbled.
The docket of Montgomery County Pennsylvania criminal court today reflects a change in the prosecution procedure of this case. The four cases will be consolidated to eliminate the duplication of paper work. All defendants have once again been denied ARD (Accelerated Rehabilitation Disposition.
Darlene Zachry, her sister Annetta Frackman and friends, husband and wife Lisa and William “Bill” Werneke are facing multiple charges in Pennsylvania criminal court, and now they are confronted with a $50,000.00 (plus) law suit by attorney, Mark Himsworth who was on the losing side of a successful will contest by Shirley Sanservino, the mother of Raymond Zachry, in Montgomery County, Pennsylvania.

When “the widow” discovered her husband was so inconsiderate as to die before leaving a will she solicited the assistance of her sister Annetta Frackman and friends Lisa and Bill Werneke to witness the computer generated signature on the bogus “will” she “found”.
All was going well until “the widow” decided to use that same computer generated signature of her late husband on another document. This one was a letter supposedly written by Raymond Marc Zachry two months prior to his death and would make her the beneficiary of a life insurance policy (he also forgot to make her the beneficiary of prior to his death). The proceeds would go to her mother-in-law, Shirley Sanservino.
But wait, if I just copy and paste this signature onto a letter, who will ever know, Darlene probably assumed since it passed the scrutiny of the Montgomery County Pennsylvania register of wills it would go undetected with New York Life Insurance Company.
However, the widow did not realize that her action would trigger a law suit by New York Life Insurance Company and involve her mother-in-law. Mom immediately recognized the signature of her son as “strange” and conferred with a document examiner who confirmed her suspicion. Then, the legal battle was unleashed in Orphans Court as Raymond Marc Zachry’s mother filed a will contest that lasted three years before a ruling in her favor by Honorable Judge Stanley Ott, and was reaffirmed by an appeal court.
Three years later, “the widow” Darlene Zachry and her friends are facing multiple charges in criminal court for perjury, fraud, conspiracy and many other related charges; and now a $50,000.00 law suit by the attorney, Mark Himsworth who claims he suffered financial damages when he lost the case in court due to the widow “not being truthful in court” as Darlene confessed in a letter to Honorable Judge Stanley Ott.
