Raymond is finally home with his family

Yesterday, August 5, 2011 Ray’s sister Katharine Mackie and his Mother, Shirley Sanservino brought Raymond’s cremated remains home to a place of rest with his family.

Montgomery County Orphans Court on Thursday August 4, 2011:  

A hearing  was held that would complete a proceeding originated by C. Scott Shields, Esquire prior to his untimely death from a skydiving accident,  Judge Stanley Ott was hearing the case to decide attorney fees and costs in the nearly three-year contest of the will forgery case of Raymond Marc Zachry.

Jason B. Martin, Esquire of The Martin Law Firm of Blue Bell, PA representing Shirley Sanservino,  continued the claim for attorney fees for his client that had become five figures during the several years of discovery and court appearances.  His brief was detailed and the evidence, a thick, multi-page, six tab document itemized the work done by three attorneys who had worked on the case and their costs and fees.

Darlene M. Zachry chose to represent herself.  Her primary evidence and defense was offered in a letter dated June 27, 2011 that she mailed to Judge Ott to tell him she could not , afford an attorney. 

Prior to commencing the formal hearing, Judge Ott explained to Darlene that if she had an attorney he/she would tell her that anything she said during the hearing could be used against her in any other proceedings that she may be involved in and he cautioned her against saying anything on the record several times during the hearing.

Shirley Sanservino was called to the witness stand to testify and explain the volume of attorney records presented as evidence by her attorney.  One of the attorney’s invoices had many entries for research into the two lethal chemicals that were identified in the autopsy of her son Raymond.  Judge Ott asked Ms. Sanservino to explain those  entries labeled as “toxicology”and pointedly asked her if she thought Darlene had done anything to cause he son’s death. 

“I do not know sir” was her answer, adding that she had not been told any of the details regarding her son’s death, nothing about the time leading up to the incident, or following his death.  “All of this has been about trying to find answers.  Why did he have these chemicals in his system, where did they come from?  I have not been told anything “, and no one has been forthcoming with explanations the mother replied to the judge.

Establishing the validity of the claim for costs, Mr. Martin quoted some case history by case number.  Judge Ott quickly recognized the cases and gave his interpretation of how he believed those cases compared to our case. 

“This is the worst case I have ever had in my court in twenty years” Judge Ott said, adding that it would benefit all the parties if they could come to an agreement that the amount Darlene would owe would be deducted from any portion of the Maryland estate of Raymond Zachry where Ms. Sanservino was Administrator.

It was the bailiff who volunteered the use of the court room as a place to discuss details that afternoon.  Mr. Martin was able to encourage Darlene Zachry to talk to him about arranging an agreement between herself and his client.

Following adjournment of the court, Mr Martin met with Darlene who was accompanied by her son in the courtroom.  Meanwhile Ms Sanservino and daughter Katharine Mackie exited to the hallway to wait for word from their attorney.

After what seemed an eternity, Mr. Martin exited the court room with news that he had reached an agreement.  Darlene would agree to allow Raymond’s mother to have his cremains, give up any interest in the Maryland estate of her late husband in exchange for the estate relinquishing any claim to the truck Raymond had titled in his name that she subsequently gave to herself on a Maryland gift document and re-titled in Pennsylvania.  The agreement was hand written on a yellow legal pad and prepared for signing by both parties and witnessed. I took only a few minutes to complete the agreement.  Darlene’s son witnessed her signature, Katharine witnessed her mother signature.  It was done!

 Darlene and her son agreed to deliver the sealed cremation urn to the office of Jason Martin, Esq in Blue Bell, PA around noon the next day.

Tears of joy as well as sorrow – and disbelief that Raymond would soon be back with his family. It was  what Ray’s mother and sister had hoped and prayed for; not the money – just that  they would know that their loved one would be cared for and could have a respectful interment in  the family grave site in Aldino, MD.

The drive home from Norristown, PA to Fair Hill, MD was two hours.  Tomorow they would return to Blue Bell and bring Ray home.
