How interesting our day in court yesterday following several delays for many trivial excuses; attorney no-show April 23, 2012 and now the attorney is involved in a jury trial that made his appearance in criminal court impossible on June 20, 2012.
Judge Smythe gave the attorney, Jonathan T. Sobel, for Darlene Zachry a/k/a/ Zachery a pass for the April no-show and 60 days to get his act together. However Sobel apparently forgot that he had another case that was more important and quite coincidentally scheduled on the same day as the re-schedule in Montgomery County, PA criminal court. Apparently Sobel didn’t have time in these past 60 days to notify the court of the conflict in his schedule and request a reschedule prior to June 13, 2012 when he sent a letter to the court saying he would not appear, again.
No penalty, no notice to us, the victims; just a no-show.
An attorney, one of the dozen who were milling around behind the bar in the witness area, stated that he was familiar with the case and Mr. Sobel was in court in another county, but it was apparent, this attorney told the court, the case was moving toward a resolution out of court.
If this non associated attorney had this information, why didn’t Ray’s family who are the victims in this case?
Pennsylvania has a Victim Bill of Rights. Nowhere in this document does it say that news related to the case should be broadcast in court prior to notifying the victims. If a plea deal is in the works, why haven’t we been notified?
If this is justice, then criminals, GO TO PENNSYLVANIA TO DO YOUR CRIME! Especially Montgomery County, PA – you will never see the inside of a court room or detention center.

Unbelievable! How can an attorney just not show and it be okay? Does he get any kind of penalty or fine?

None. No penalty.
The judge said in court he “found” a sealed letter from the attorney in the file. Yet, when I looked at the file in the clerks office I found no such letter dated April 23.
I asked whatever happened to contempt of court for the no show. The answer, “he may have been detained or had an emergency”.
Only in Pennsylvania.

I thought PA was the birthplace of Independence not criminals. Someone sure did their research to learn PA was the best place to hide from the arms of justice.
