It has been seven years since I received that dreaded phone call

telling me my son, Raymond Marc Zachry was dead.

His widow, Darlene Miller Zachry (they had been married 18 months) had little information, and in these past seven years has refused to cooperate, refused to disclose her whereabouts, refused to talk to Ray’s family – share information how, why, when did he get so much poison into his system?  Where did the barium poison come from?

Darlene Miller Zachry served 25 days in jail in Montgomery County PA after being convicted of forgery, perjury and a long list of other felonies against her late husband and his family.  But, remained silent when asked about the circumstances of his death.  She is now enjoying life in a style she had never experienced prior to meeting Ray Zachry.

Raymond Marc Zachry received a death sentence in return for his generosity to loving care of her and her family.

Today, we remember Ray.

Abstract: By studying the number and method of homicidal poisoning in Miami-Dade County, Florida; New York City, NY; Oakland County, Michigan; and Sweden, we have confirmed that this is an infrequently established crime.

Several difficulties come with the detection of homicidal poisonings. Presenting symptoms and signs are often misdiagnosed as natural disease, especially if the crime is committed in a hospital environment, suggesting that an unknown number of homicides go undetected.

In the reported cases analyzed, the lethal agent of choice has changed over the years. In earlier years, traditional poisons such as arsenic, cyanide, and parathion were frequently used. Such poisonings are nowadays rare, and instead, narcotics are more commonly detected in victims of this crime.

Having researched death by poison since the death of my son, Raymond Zachry in 2007, there is a similarity in many cases where the cause of death is listed as heart attack, arrhythmia or disrrhythmia by the coroner or medical examiner. Ignoring the underlying symptoms of poisoning, unfamiliarity with symptoms that mimic heart attack has allowed many homicides to go undetected as the authors of the above data include in their paper.

During the six years since Ray Zachry’s death many other poisoning cases have surfaced and like Zachry’s it has remained secret even when families offer evidence and proof otherwise. Only when independent oversight boards review death certificates for incorrect cause of death analysis and other mistakes will the homicide by poisoning become recognized on sudden, unattended death cases.

LUMBERTON — A Superior Court judge this week ruled that two wills naming former Robeson County Attorney Hal Kinlaw as executor were forgeries.

Judge Mary Ann Tally, during a hearing in Robeson County Superior Court, ruled in favor of petitions submitted by Jessie McFadyen Tolar, of Red Springs, requesting that the wills of her mother, Louise B. McFadyen, and father, Robert Lewis McFayden, be “removed and set aside” and authentic wills be substituted in their place.

The Robesonian has been told that Kinlaw as well as his late father had business relationships for many years with Lewis McFayden. According to the petition filed by Tolar, Kinlaw resigned as executor of both of her late parents wills on March 26, 2013.

The petition to the court said that on the same day Kinlaw resigned as executor of the estates, Tolar was appointed administrator of her parents’ estates and executor of their wills. After her appointment, according to the petitions, she discovered that Louise McFadyen’s 2009 will naming Kinlaw executor was “in fact a forgery and never executed by the decedent.” She also found the 2005 will of Lewis McFadyen to be a forgery.

According to the petitions, Kinlaw would not have received anything of value in either of the forged wills.

A court official confirmed that the action taken Monday did not include any criminal charges. It was unclear Friday, however, if further action will be taken in criminal court. An assistant to Tolar’s attorney, Hilton T. Hutchens Jr. of Fayetteville, told The Robesonian that Hutchens would “not make any comment at this time.”

Raymond Marc Zachry, the subject of this blog is an example of a forged will that was filed for probate in Montgomery County Pennsylvania .

The widow Darlene Miller Zachry, conspired with her sister Annetta Frackman and friends Lisa and William “Bill” Werneke to compose the document they called a will and file it for probate to acquire his assets that were located in Conowingo, Maryland and Souderton, Pennsylvania.
Ray’s mother, author of this blog and his sister Katharine Mackie paid fees and expenses that totaled over $70,000 to prove the will a forgery. (Documents are available to view at the website http://www.denied-justice.com

OUR OPINION: Residents to the west should have been told about contamination concerns

Once dangerously high levels of toxins were found at Blanche Park in Coconut Grove last week, the city of Miami kicked into high gear: Commissioner Marc Sarnoff on the case, nearby residents informed, park closed, soil capped, borings’ samples examined, kids and Golden Labradors safe. And that’s just what should have happened. Once the findings were known, residents’ health and well-being were paramount.

So why did it take the city two years to adequately address the troubling findings in another neighborhood — the less tony, but ever hardy, West Grove? In 2011, the city discovered contaminated soil there as it was considering the expansion of a firefighter training facility. The facility sits on the site of an incinerator — Old Smokey — that spewed ash from the 1930s until it was closed in 1970.

Older residents in the historic black enclave remember superheated ash igniting roofs. The site sits amid homes, a park and a community center for school kids.

But once alerted, the city never moved with any sense of urgency. Within a few months, Miami-Dade County’s Department of Environmental Resources Management (DERM) gave the city 60 days to determine what was polluting the soil and what risk it posed to residents. Didn’t happen.

Then the city missed another deadline in August 2011, saying there was no money for a study. The city, indeed, was in dire financial condition, so the study didn’t happen, either. Guess there weren’t enough Golden Labs in that neighborhood.

One other thing didn’t happen: The city didn’t tell residents of the area of the findings on the facility grounds or of concerns for their neighborhood. West Grove homeowners weren’t informed until earlier this year, when a University of Miami graduate student uncovered the initial findings while researching the construction of a nearby trolley garage — for Coral Gables — that many residents don’t want in their midst.

For those two years, children continued to play at Armbrister Park, and students went to the community center after school.

In May of this year, the city at long last submitted a report that confirmed elevated levels of arsenic, which can be naturally occurring, along with other toxic heavy metals including barium and lead on the site, above what the state allows in residential areas.

This is an infuriating tale of two cities that someone needs to explain to the residents of the West Grove. Maybe Mr. Sarnoff will be so inclined at a community-wide meeting scheduled for Monday. There, all Groveites can get an update from DERM on contamination findings and the way forward.

Ironically, the contamination at Blanche Park was discovered because, during its probe of the West Grove, DERM ordered random soil samplings across a wider swath.

The ash at Blanche seems to indicate it was used as a dump decades before.

The commissioner says he never knew of the initial findings of contamination at the firefighter facility in 2011. Once he was alerted this June, he says, he took “forceful” action, meeting with city administrators and DERM and ordering parks and school grounds in the area tested.

Riled West Grove residents, however, might have reason to be somewhat relieved. Wilbur Mayorga, of DERM, said Friday that preliminary findings unearthed no reason for health concerns.

After years of neglect and delay, it’s no wonder West Grove residents feel the city treats them like second-class citizens.

Today we remember our loving son, Raymond Marc Zachry, not because of another outstanding accomplishment – rather it is the six-year anniversary of his sudden, unattended death.

Six years; and only denial from the coroner who claims he died from a heart attack…with 1950 mcg/L of barium in his blood toxicology.  Enough, says toxicologist Dr. Woody Hartgrove, to have rapidly caused his death.  It would cause his heart to stop…paralyze his limbs… and reduce the available potassium to cause his heart to stop according to Center for Disease Control material safety data report.  The amount was nearly equal to the amount Marie Robard, a student in Texas, took from her high school chemical laboratory to poison her father.

Montgomery County Pennsylvania does not find it important enough to investigate the source of the lethal, heavy metal that caused Raymond Zachry’s death.

Miami Herald reported this story of a contaminated site that was being closed to residents due to several hazardous chemicals found in the soil.  Barium was included in  that sampling.

Last month, the city and the county’s Department of Environmental Resources Management (DERM) widened testing sparked by the discovery of lead, barium and other toxic metals more than two years ago at the site of the city’s fire training facility at 3425 Jefferson St. in Coconut Grove.

Barium is a metal used in oil and gas industries and to make paint, bricks, ceramics, glass and rubber. It poses risks to the cardiovascular system, digestive tract and reproductive health.

Warning signs, fencing and rangers keep visitors away due to the hazardous chemicals found on the site, according to the article…

Montgomery County Pennsylvania – does not care where this chemical came from, how it caused one residents death, and the possibility that it could cause more unsuspecting citizens death.

Shameful neglect, disregard for environmental hazards, Pennsylvania, could be the next Miami, Florida disaster.

Case dismissed against medical examiner for incorrect diagnosis

The case involving Mississippi Medical Examiner, Dr. Steven Hayne, has been ongoing for several years.  It illustrates the incompetence of coroners/medical examiners who claim ‘forensic’ credentials.  But, has anyone verified those credentials?

A federal judge has dismissed without prejudice a lawsuit brought against forensic pathologist Dr. Steven Hayne, the former chief medical examiner of Mississippi, by a woman who claims Dr. Hayne’s “unsupported and untrue” statements to law enforcement about his findings in an autopsy led to her wrongful prosecution for murder.

On May 1, 2002, James Neal May, the man living with Ms. Jennifer Wardle Hollis, was found dead in the home they shared of a gunshot wound to the back of the head.  Local law enforcement ruled the death a suicide, and two separate grand juries failed to indict Ms. Hollis.

At some point after the grand juries’ decisions, Mr. May’s body was exhumed and autopsied by Dr. Steven Hayne, who ruled Mr. May’s death was “not suicide.”  Dr. Hayne apparently reported his findings to state officials, who then indicted Ms. Hollis for murder in 2007.

Her trial began on March 15, 2010 and the jury acquitted her just three days later.

Ms. Hollis filed suit against Dr. Hayne on March 15, 2013, exactly three years to the day when her murder trial began.

Commentary:

While Dr. Hayne is no longer on the hook for Ms. Hollis’ case (unless she decides to re-file), he is still a controversial figure and has several unresolved issues.

In April of this year, the Mississippi Supreme Court threw out his testimony and ordered a new trial in the case of a man who was convicted of murdering his wife with a shotgun.  In that case, Dr. Hayne reportedly never tested or even saw the shotgun used before the trial, or even visited the crime scene.

The opening sentence in the report from The People’s Voice and it had my attention. The similarity to Ray’s story is compelling me to read on.

Raymond Zachry date of death:  September 25, 2007.

Date of the autopsy report: January 10, 2008

Date Ray’s family received a copy:  March 2008, six months later!

It took four months for Montgomery County Pennsylvania coroner office to find an attorney/pathologist to sign Ray’s autopsy.  Why didn’t the newly elected coroner Walter Hofman sign the autopsy?  Or, why didn’t the nurse/corner Ottinger sign the autopsy report?  Why were reports missing?  Why redactions, mysterious notes, alterations?

The following makes Ray’s story more alarming:

“Six months after Charles Castle suddenly and inexplicably died, the San Bernardino County Coroner has still not come up with a stated cause of death. And according to a Deputy in that office, a critical report is “missing” from Charlie Castle’s file.”

Death investigation industry gone wild…

At the web site http://denied-justice.com is posted the laboratory toxicology report from the autopsy that was furnished to my physician and another that was furnished to an attorney on my  behalf.  The  two reports are strikingly different.  However both confirm the presence of a lethal chemical in the blood sample furnished by the coroner of Montgomery County Pennsylvania.  Both of the reports are altered, but by whom?  No one will answer these questions…one report redacted the quantity that was probably more accurate than the one that was later furnished to Coroner at her faxed request…(also posted on this web site).  What to do?

According to the president of the Massachusetts Association of Criminal Defense Attorneys, the:

lab analyst in question had unsupervised access to the drug safe and evidence room, and tampered with evidence bags, altered the actual weight of the drugs, did not calibrate machines correctly, and altered samples so that they would test as drugs when they were not.

Ms. Dookhan, who apparently also falsely claimed to have a Master’s degree in chemistry, had a reputation for being the most productive tech in the lab; she would routinely process more than 500 cases per month, when an average tech could only process 50-150 cases per month.

She was also a darling to prosecutors working on drug cases.  This may be because she would reportedly work on cases out of order for some prosecutors when asked, deliberately report negative tests as positive and report results for cases she never even analyzed.

While the impact this one chemist has had is incredible, the state’s public defender is worried there may be more than just one tech who have “cut corners or falsify results.”
